Terms of Service

1. Acceptance of Terms

By accessing or using Role Playing Story ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. You must be at least 17 years old to use this Service. This Service is for ages 17+ and is NOT a children's service. See our Age Suitability page for full details.

Perspectivity, LLC ("Company", "we", "us", or "our") reserves the right to refuse service to anyone for any reason at any time.

2. User-Generated Content

By submitting content to the Service, including custom actions, story contributions, and any AI-generated images or text arising from them ("User Content"), you assign to us all right, title, and interest in and to your User Content, including all intellectual property rights. This includes the perpetual, irrevocable, worldwide, royalty-free right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly display, sublicense, and commercially exploit your User Content in any form or medium β€” including producing, licensing, and selling merchandise, prints, or other products derived from it through third-party partners.

You represent and warrant that you own or have the necessary rights to submit your User Content and that it does not violate any third-party rights or applicable laws.

3. AI-Generated Content

The Service uses artificial intelligence to generate story content, translate user actions, and create images. AI-generated content may be inaccurate, offensive, or harmful. We provide no warranty regarding the quality, appropriateness, or accuracy of AI-generated content.

You are responsible for reviewing AI translations before approving them. We are not liable for any AI-generated content. While we use automated moderation, it is not perfect and may not catch all inappropriate content.

4. Post-Generation Editing

PAGES ON THIS SERVICE ARE LIVING DOCUMENTS, NOT FINAL ONES. After a page is published, the Service routinely and automatically edits that page's text and imagery β€” for continuity, quality, and narrative craft β€” without further notice to you or to other readers. This is not an error; it is a deliberate, core part of how stories on this platform are built and refined.

Content you or other users contributed may be revised this way at any time, repeatedly, for as long as it remains part of the Service.

5. Intellectual Property

The Service, including its code, design, and trademarks, is owned by Perspectivity, LLC. Defensive patent pending on collaborative story tree system where user-created branches become available to all users.

You may not reverse engineer, copy, or redistribute any part of the Service without our express written permission.

6. Points, Virtual Currency, and Subscriptions

Points are virtual currency with no real-world value and are non-transferable. Points are purchased through in-app purchases processed by the Apple App Store or Google Play Store, depending on your device. If an operation fails due to technical issues (timeout, error, or service unavailability), points will be automatically refunded. No refunds are provided for successful operations you don't like. We may adjust point costs, balances, or mechanics at any time without notice.

We also offer an optional auto-renewing monthly subscription, purchased through the Apple App Store or Google Play Store, which grants unlimited action translation and page generation subject to a fair-use rate limit intended to prevent abuse. Your subscription automatically renews each billing period at the then-current price unless you cancel before the renewal date. You can cancel anytime through your Apple ID account settings (iOS) or the Google Play Subscriptions page (Android); cancellation takes effect at the end of the current billing period, and you will retain access until then.

A subscription is not a permanent or guaranteed state. It can end through your own cancellation, non-renewal, a failed payment, or removal by Apple or Google under their own policies. We are not responsible for subscription interruptions caused by the app stores. Refunds for subscription charges are handled by Apple or Google according to their own policies, not by us.

7. Prohibited Content

Profanity, violence, and adult content are explicitly permitted within narrative fiction. You may not submit content that contains: hate speech, sexual violence, real-world harassment (fictional harassment within story narratives is permitted), self-harm promotion, hateful profanity (except where it serves a compelling narrative), spam, impersonation, intellectual property infringement, or malware.

Every published story also carries an explicit content rating β€” PG-13 or R β€” describing what kind of mature content it contains. See our Age Suitability page for the full rating system. The prohibited-content rules above apply regardless of a story's rating; a higher rating permits more intense violence or language, never any of the categories listed above.

This prohibited content list is subject to immediate change at any time without notice. This is a new kind of platform and our tolerances for content boundaries will be discovered over time. What is permitted today may be prohibited tomorrow, and vice versa.

8. Content Moderation

We use automated moderation and user reports to identify inappropriate content. We reserve the right to moderate, reject, or remove any content that violates these Terms. We have no obligation to monitor all content.

9. Account Termination and Content Persistence

We may terminate your account for violations of these Terms, with notice for minor violations and immediate termination for severe violations. You may delete your account at any time (see our Delete Account page). Upon termination, you will lose access to your points and your personal account data.

Deleting or losing access to your account does not remove your published User Content from the Service. Story pages and branches you contributed remain part of the shared story tree and continue to be visible to other users after your account is gone β€” this is a fundamental part of how the collaborative story tree works. Removal of a specific page from the Service is a separate decision, made only when that page itself is specifically determined to require removal (for example, a successful DMCA takedown or a serious content-policy violation), independent of whether the contributing account still exists.

10. Third-Party Services

The Service depends on third-party providers including AWS (hosting, database, storage), OpenAI/AWS Bedrock (AI services), and AWS Cognito (authentication). We are not liable for third-party service failures or outages.

11. App Store Terms

If you obtained the Service through the Apple App Store or Google Play Store, the following additional terms apply:

These Terms are between you and Perspectivity, LLC only, not with Apple Inc. or Google LLC. Neither Apple nor Google has any obligation to furnish maintenance or support for the Service. Perspectivity, LLC, not Apple or Google, is solely responsible for the Service and its content, and for addressing any claims relating to it, including product liability claims, legal or regulatory compliance claims, and consumer protection claims.

In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple or Google, and they may refund the purchase price for that item, if any; to the maximum extent permitted by applicable law, Apple and Google have no other warranty obligation whatsoever with respect to the Service. Perspectivity, LLC, not Apple or Google, is responsible for investigating, defending, settling, and discharging any claim that the Service or your use of it infringes a third party's intellectual property rights. You must comply with any applicable third-party agreement terms (for example, your wireless data service agreement) when using the Service.

Apple Inc., Google LLC, and their respective subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, each will have the right to enforce these Terms against you as a third-party beneficiary.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. This Service is operated by a solo developer and may experience downtime, limited support hours, and service interruptions.

This Service is in early general release and under continuous, active development. Features may change, and you may occasionally encounter bugs or outages as we keep improving it. We provide no guarantee of uninterrupted uptime.

13. Limitation of Liability

Our total liability shall not exceed $100 or the amount you paid us in the 12 months prior to the claim, whichever is greater. This limitation does not apply where prohibited by law.

14. Indemnification

You agree to defend, indemnify, and hold harmless Perspectivity, LLC from any claims arising from your User Content or violations of these Terms.

15. DMCA Copyright Policy

We respond to valid DMCA takedown notices. To report copyright infringement, contact our designated agent at perspectivity.space@gmail.com with: (1) identification of copyrighted work, (2) identification of infringing material, (3) your contact information, (4) statement of good faith belief, and (5) statement of accuracy under penalty of perjury.

We will terminate accounts of repeat infringers.

16. Dispute Resolution

Before filing a lawsuit, please contact us at perspectivity.space@gmail.com to attempt informal resolution. If informal resolution fails, disputes shall be resolved in the courts of Alabama.

17. Governing Law

These Terms shall be governed by the laws of the State of Alabama, without regard to its conflict of law provisions.

18. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via in-app notification. Continued use after notification constitutes acceptance of the new Terms.

19. International Users

The Service is available internationally. Your data may be transferred to and processed in the United States. You have rights to access, delete, and port your data as described in our Privacy Policy.
